1. Purpose and Scope This Policy explains how KLCA, LLC, doing business as Kris Wilcox Racing ("KWR"), evaluates and addresses concerns involving Products and Services supplied or directly performed by KWR. Its purpose is to resolve legitimate concerns fairly, consistently, and using sound engineering practices.

2. Relationship to Governing Documents This Policy supplements the KWR Terms of Service and Definitions & Interpretation document. If a conflict exists, the Terms of Service govern unless a Separate Written Agreement expressly provides otherwise.


3. What KWR Stands Behind KWR stands behind the quality of work it directly performs. Every reported concern is evaluated individually using the Engineering Baseline, Business Records, inspection findings, diagnostic information, and professional judgment. KWR does not presume that every reported concern is caused by KWR, nor does it presume that the Customer or another party is responsible.


4. Workmanship Commitment KWR provides a thirty (30) calendar day Workmanship Commitment beginning upon Customer acceptance of the completed Products or Services unless a Separate Written Agreement expressly provides otherwise. The Workmanship Commitment applies to Verified Workmanship Issues directly resulting from Products or Services performed by KWR. It is separate from any Manufacturer Warranty and does not create a KWR warranty covering Products manufactured or supplied by third parties.
Evaluation under the Workmanship Commitment is based upon the Engineering Baseline and configuration existing when KWR completed the applicable work. Submission of a concern does not automatically establish a Verified Workmanship Issue or entitlement to a particular remedy.


5. Reporting a Concern Customers should notify KWR as soon as reasonably practicable after discovering a concern. Prompt communication helps preserve evidence, maintain the Engineering Baseline, reduce the possibility of additional damage, and improve KWR's ability to evaluate the condition accurately.
•    Customer and Vehicle identification;
•    Applicable invoice, repair order, or Order number;
•    Date and conditions when the concern was first observed;
•    Photographs, video, scan data, logs, or diagnostic information where available;
•    Any Material Modifications, repairs, tuning, or configuration changes performed after KWR completed the work.


6. Initial Review, Documentation, and Timeline KWR may request photographs, video, scan-tool data, calibration information, maintenance history, invoices from other service providers, removed components, shipping documentation, or other information reasonably necessary to evaluate the reported concern. Preliminary observations are informational and do not constitute final engineering conclusions. KWR will make reasonable efforts to acknowledge reported concerns and begin evaluation within a reasonable time after receiving sufficient information. Completion time varies with complexity, availability of the Vehicle or Product for inspection, parts or technical information, manufacturer involvement, and other project-specific circumstances.


7. Inspection and Diagnostic Evaluation Before another person or entity materially alters, repairs, disassembles, replaces, programs, calibrates, or otherwise modifies the subject of a reported concern, the Customer should provide KWR a reasonable opportunity to inspect and evaluate the condition whenever practicable. KWR may use visual inspection, testing, measurement, diagnostics, software analysis, calibration review, comparison against the Engineering Baseline, or other appropriate engineering methods. If the concern is determined not to be a Verified Workmanship Issue, inspection, diagnosis, testing, disassembly, or related Services may be subject to normal KWR service rates, provided the Customer is informed before billable work proceeds beyond the authorized scope.


8. Verified Workmanship Issues and Resolution A reported concern becomes a Verified Workmanship Issue only after KWR has completed a reasonable evaluation and determined that the condition was directly caused by Products or Services performed by KWR. If verified, KWR may inspect, adjust, repair, replace KWR-performed work, recalibrate, reprogram, perform additional testing, or provide another reasonable corrective measure consistent with the Terms of Service. If the concern falls outside the Workmanship Commitment, KWR will explain its findings and, where reasonably appropriate, may recommend available repair, diagnostic, engineering, or Manufacturer
Warranty options. Billable corrective work outside the Workmanship Commitment requires Customer authorization.


9. Manufacturer Warranties Products supplied by KWR may include Manufacturer Warranty coverage administered by the applicable manufacturer or supplier. KWR may reasonably assist Customers with applicable warranty procedures, but KWR cannot approve, deny, modify, or extend third-party warranty coverage. Labor for diagnosis, removal, installation, shipping, programming, testing, or other Services required for a Manufacturer Warranty claim remains the Customer's responsibility unless otherwise covered or agreed in writing.


10. Customer-Supplied Parts KWR respects a Customer's decision to supply Products where appropriate and compatible with the authorized project. KWR's Workmanship Commitment remains limited to installation work directly performed by KWR and does not extend to the design, manufacture, quality, authenticity, compatibility, configuration, or failure of the Customer-Supplied Part itself. KWR encourages purchasing Products directly through KWR whenever practical. Purchasing through KWR generally improves product traceability, simplifies warranty administration, reduces compatibility concerns, streamlines technical support, and allows direct coordination with manufacturers and suppliers. KWR offers price matching on qualifying Products in accordance with applicable KWR pricing practices.


11. Material Modifications and Configuration Changes Material Modifications performed after completion do not automatically eliminate eligibility under the Workmanship Commitment. They may, however, alter the Engineering Baseline, affect causation, or limit KWR's ability to determine whether a reported condition relates to the original work. New engineering, redesign, recalibration, validation, or testing required because the Customer changes the Original Vehicle Configuration or Original System Configuration constitutes additional Services unless otherwise agreed in writing.


12. Modified and Competition Vehicles KWR supports street, high-performance, exotic, specialty, competition, and purpose-built Vehicles. Evaluation considers the intended use communicated by the Customer when the Engineering Baseline was established. Track use, competition, dyno testing, endurance operation, and other high- demand environments place increased loads on Vehicle systems and are considered as part of engineering evaluation.


13. Customer Responsibilities
•    Inspect completed work at delivery and promptly communicate questions or concerns;
•    Maintain and operate the Vehicle using reasonable engineering practices and applicable manufacturer recommendations;
•    Disclose known changes, modifications, tuning, repairs, warning indicators, unusual noises, drivability concerns, or other materially relevant information;
•    Cooperate with reasonable requests for inspection, logs, scan data, photographs, or documentation;
•    Discontinue operation as soon as reasonably practicable if continued use appears likely to increase damage or create a safety concern.


14. Shipping and Evidence Preservation When a shipped package appears damaged, KWR recommends assuming concealed damage may exist until the shipment has been fully inspected. Customers should photograph the unopened package, labels, visible damage, packaging materials during unpacking, and the Product immediately after removal, and should retain packaging until the matter is evaluated. Thorough documentation can materially assist the Customer, KWR, fulfillment partner, carrier, and insurer.


15. Goodwill Accommodations KWR may, at its sole discretion, provide technical guidance, diagnostic assistance, reduced labor, discounted Services, expedited scheduling, manufacturer coordination, or other assistance beyond contractual obligations. A Goodwill Accommodation is voluntary and does not establish an admission, precedent, or continuing obligation.

ECU Programming & Calibration Policy

1. Purpose and Scope This Policy explains how KWR approaches ECU, TCU, and related electronic programming and calibration services, including engineering evaluation, Vehicle suitability, programming methods, validation, remote work, data logging, configuration changes, and support.


2. Engineering Philosophy ECU calibration is an engineering discipline rather than a numerical exercise. The objective is to improve the overall driving experience while maintaining appropriate consideration for drivability, reliability, component capability, intended use, and the complete Vehicle system. Every Vehicle is different. Manufacturing tolerances, operating environment, maintenance history, fuel quality, hardware configuration, software version, and previous modifications can influence calibration requirements. KWR does not treat calibration as a universal one-size-fits-all exercise.


3. Scope of Services
•    ECU and TCU programming;
•    OBD, bench, and boot programming;
•    ECU unlocking;
•    Remote tuning and mail-in programming;
•    Calibration revisions where appropriate;
•    Software updates;
•    Diagnostic evaluation and data-log analysis;
•    Engineering consultation.


4. Vehicle Suitability Calibration cannot correct underlying mechanical deficiencies. Customers are responsible for presenting a Vehicle reasonably suitable for the requested work and for following KWR recommendations regarding mechanical concerns that materially affect calibration.


5. Mandatory Disclosure Customers must disclose all known modifications, previous tuning, aftermarket components, software changes, electronic systems, recent repairs, diagnostic trouble codes, known mechanical concerns, and other information reasonably relevant to the Vehicle and requested Services. The purpose is to establish an accurate Engineering Baseline and improve engineering efficiency - not to criticize previous work.


6. Engineering Baseline and Original Vehicle Configuration Before modifying calibration data, KWR may establish an Engineering Baseline using Vehicle information, diagnostic data, software identification, operating data, Customer-provided information, and other appropriate observations. The Original Vehicle Configuration is the documented configuration upon which the originally authorized calibration engineering is based.


7. Programming Methods and Equipment Depending on Vehicle architecture, software, module security, manufacturer requirements, and available tooling, KWR may use OBD, bench, boot, unlock, remote, mail-in, or other appropriate programming methods. KWR uses qualified programming equipment, software platforms, and engineering tools appropriate to the application.


8. Calibration Validation Validation may include diagnostic review, data analysis, controlled testing, chassis dynamometer testing, data logging, calibration verification, or other appropriate engineering methods. Performance may vary because of mechanical condition, fuel quality, altitude, environment, hardware, component tolerances, software versions, and operating conditions. Unless expressly stated in a Separate Written Agreement, KWR does not guarantee a specific horsepower, torque, elapsed time, acceleration, fuel economy, or other performance figure.


9. Road-Test Limitations KWR will not intentionally violate traffic laws or operate a Customer Vehicle unsafely or unnecessarily aggressively to reproduce a concern. Extreme-performance conditions may require a dyno, controlled testing, Customer-provided data, or separately arranged track evaluation.


10. Data Logging and Customer Participation Customers may be asked to provide logs, diagnostic information, photographs, video, or other information necessary to evaluate operating conditions that cannot be reproduced during shop testing. Successful remote calibration requires timely Customer participation and accurate adherence to KWR instructions.


11. Vehicle Configuration Changes and Retuning The delivered calibration is engineered for the Original Vehicle Configuration unless otherwise documented. Changes to hardware, forced induction, fuel systems, injectors, intake, exhaust, sensors, electronics, gearing, tire diameter, software, fuel type, or other relevant systems may require new engineering evaluation and recalibration. Calibration refinements addressing the originally authorized scope may be handled under the applicable support or Workmanship Commitment. **A retune required because the Customer makes additional modifications is new engineering work and is generally billable.** Customers are encouraged to discuss future modifications before calibration so KWR can help plan an efficient upgrade path.


12. Post-Calibration Support KWR remains available for reasonable questions and support consistent with the purchased Products and Services. Customers should notify KWR of Material Modifications or Vehicle Configuration changes that may affect operation.


13. Intellectual Property and Customer Use Calibration files, strategies, maps, definitions, methodologies, development processes, and supporting engineering information may contain KWR or third-party intellectual property. Unless otherwise agreed in writing, purchase of calibration Services authorizes legitimate use of the delivered calibration for the applicable Vehicle and Vehicle Configuration but does not transfer ownership of KWR's underlying calibration methodologies, proprietary definitions, or Background Intellectual Property.


14. Administration This Policy should be read with the Terms of Service, Warranty & Workmanship Policy, Shop Services Policy, Shipping Policy, Customer Portal & Electronic Communications Policy, and Definitions & Interpretation.
 
Performance Electronics & Systems Integration Policy
  
1. Purpose and Scope This Policy explains how KWR approaches design, integration, installation, programming, documentation, validation, and support of performance electronics and integrated vehicle systems.


2. Engineering Philosophy Successful electronics integration begins with system engineering rather than component installation. Wiring, programming, and hardware installation are implementation of an engineered solution - not the engineering itself. KWR seeks systems that are reliable, serviceable, scalable, and appropriate for the intended use.


3. Guiding Principles
•    Engineering before assembly;
•    System architecture before component selection;
•    Reliability before unnecessary complexity;
•    Documentation is part of the finished product where appropriate;
•    Future serviceability is a design requirement;
•    Expansion should be considered whenever reasonably practical.


4. Scope of Services
•    Standalone ECUs;
•    PDM and power-distribution systems;
•    CAN bus integration;
•    Dash displays and data acquisition;
•    Sensors and GPS;
•    Driver controls and switch panels;
•    Wiring-harness integration;
•    Motorsports electronics, telemetry, cameras, and custom control systems.


5. Mandatory Project Disclosure Customers must disclose known modifications, existing electronic systems, previous wiring changes, aftermarket equipment, software changes, and other information reasonably relevant to the project. Understanding future plans can allow KWR to reserve capacity, choose scalable architecture, and reduce later rework.


6. Engineering Baseline Before engineering begins, KWR may document existing Vehicle Configuration, electronic systems, wiring, communication networks, module inventory, software versions, sensors, Customer objectives, future expansion plans, and operational requirements.


7. System Documentation When appropriate to the Scope of Work, Project Deliverables may include wiring diagrams, connector and pin information, fuse allocation, CAN information, configuration settings, module identification, programming notes, and service recommendations. Documentation may require revision if the system later changes.


8. System Validation Validation may include functional testing, CAN communication verification, sensor checks, input/output testing, power distribution verification, programming checks, data acquisition verification, fault monitoring, diagnostics, and controlled operational testing. Some functions cannot be safely or legally validated on public roads. Appropriate alternatives may include controlled testing, chassis dynamometer work, Customer-assisted evaluation, or separately contracted track validation.


9. Original System Configuration and Changes KWR's validation, programming, and documentation are based on the Original System Configuration established at completion. Changes to wiring, modules, sensors, power distribution, communication networks, software, firmware, or accessories may affect compatibility and require new engineering, programming, documentation, validation, or troubleshooting. These are generally separately billable Services unless otherwise agreed.


10. Quality Control and Customer Orientation Before completion, KWR may perform Quality Control inspections appropriate to the work. When appropriate, KWR will explain operation of newly installed systems, controls, interfaces, maintenance considerations, and other information reasonably necessary for effective use.


11. Intellectual Property and Serviceability Customers may use KWR-provided technical deliverables for legitimate operation, maintenance, repair, modification, and support of the Vehicle or Project for which they were supplied, including providing relevant documentation to future technicians or service providers. KWR retains ownership
of its Background Intellectual Property, internal methods, templates, and proprietary engineering materials unless a Separate Written Agreement expressly provides otherwise.


12. Administration Custom-development ownership, licensing, exclusivity, source materials, reproduction rights, or commercial-use rights may be separately negotiated in an applicable Statement of Work or Separate Written Agreement.
 
Motorsports Services Policy

1. Purpose and Scope This Policy explains how KWR provides motorsports engineering, technical support, race operations, timing systems, electronics support, data services, vehicle preparation, and other event-related Services.


2. Motorsports Service Philosophy Every motorsports program is unique. No two Customers, Vehicles, disciplines, budgets, schedules, objectives, or operational requirements are identical. KWR therefore does not offer or imply one standardized level of track support. Services are intentionally modular and ad hoc by design. Some Customers require comprehensive engineering and operations support; others need only specific technical services. The objective is to build the appropriate program around the Customer's goals and available resources rather than require unnecessary services.


3. Nothing Is Assumed No motorsports service, personnel, equipment, tooling, repair capability, data service, calibration support, electronics support, race operation, timing service, logistics support, spare-parts management, or post-event deliverable is implied or automatically included.


4. Mandatory Pre-Event Agreement All track support, race support, event operations, engineering Services, and motorsports activities provided by KWR are planned, negotiated, and documented before the event. Every event is governed by a Motorsports Services Agreement, Statement of Work, or other Separate Written
Agreement defining the applicable scope, personnel, schedule, pricing, responsibilities, resources, and expectations.


5. Possible Services
•    Vehicle preparation and pre-event inspection;
•    Engineering support and technical consultation;
•    ECU, electronics, and calibration support;
•    Data acquisition and analysis;
•    Timing and scoring;
•    Race operations and pit-lane support;
•    Trackside diagnostics or repairs when specifically included;
•    Logistics assistance;
•    Post-event engineering review or reporting when included.


6. Event Planning Pre-event planning may establish Vehicle information, current Vehicle Configuration, recent modifications, known concerns, event schedule, credentials, staffing, tools, equipment, spares, travel, lodging, transportation, support hours, communication methods, billing terms, and other requirements necessary for the agreed program.


7. Dynamic Event Environment Weather, track conditions, schedules, regulations, technical issues, red flags, equipment failures, third-party actions, and competition priorities may change rapidly. KWR applies professional judgment within the pre-negotiated scope and available resources.


8. Trackside Repairs Trackside repairs, emergency engineering, fabrication, component replacement, recovery assistance, and similar support are provided only when included in the applicable event agreement or when a documented scope change is authorized and KWR has the personnel, equipment, time, and ability to provide the additional service. Temporary repairs may be intended only to safely complete an event or facilitate transportation. KWR may recommend permanent repair or further inspection before continued operation.


9. Testing and Driver Responsibility Competition Vehicles may operate under conditions that cannot be meaningfully reproduced outside a controlled motorsports environment. Evaluation may include telemetry, data acquisition, driver feedback, systems monitoring, calibration review, video, and timing information. The driver remains responsible for safe Vehicle operation and judgment regarding track conditions and Vehicle behavior.
10. Event Outcomes KWR cannot guarantee race results, finishing positions, lap times, championships, podium finishes, or uninterrupted Vehicle operation. Professional preparation and engineering support reduce risk and improve decision-making but do not eliminate the inherent unpredictability of motorsports.


11. Intellectual Property and Project-Specific Rights Project-specific data, reports, configurations, technical materials, licensing, exclusivity, or custom development rights may be defined in the applicable Motorsports Services Agreement or Statement of Work. No ownership or service is assumed beyond what the written event scope provides.
